PRIVACY - MEMBERSHIP AGREEMENT

1. Parties;

a) HAMİDİYE ŞEKERLEME SAN.VE TİC.LTD.ŞTİ., which operates the website online.hafizmustafa.com, conducts its business at the address: ŞENLİKKÖY MAH. YEŞİLKÖY HALKALI CAD. AQUA FLORYA AVM 93/3 BAKIRKÖY/ İSTANBUL.

b) The internet user who becomes a member of the website online.hafizmustafa.com (the "Member")

2. Subject of the Agreement;

The subject of this Agreement is to determine the terms and conditions under which the Member may benefit from the website online.hafizmustafa.com, owned by HAMİDİYE ŞEKERLEME.

3. Rights and Obligations of the Parties;

3.1. The Member represents and undertakes that the personal and other information provided when becoming a member of the website online.hafizmustafa.com is accurate before the law, and that the Member will immediately and fully compensate HAMİDİYE ŞEKERLEME for any and all damages it may incur due to the inaccuracy of such information.

3.2. The Member may not give the password provided by HAMİDİYE ŞEKERLEME to any other person or entity; the right to use this password belongs solely to the Member. All liability arising from this, as well as all claims and demands that may be brought against HAMİDİYE ŞEKERLEME by third parties or competent authorities, shall be borne by the Member, and HAMİDİYE ŞEKERLEME reserves all rights to compensation and any other claims arising from such unauthorized use.

3.3. The Member accepts and undertakes in advance to comply with the provisions of applicable legislation while using the website online.hafizmustafa.com and not to violate them. Otherwise, all legal and criminal liability that may arise shall bind the Member fully and exclusively.

3.4. The Member may not use the website online.hafizmustafa.com in any way that disturbs public order, is contrary to general morality, disturbs or harasses others, serves an unlawful purpose, or infringes upon the intellectual and copyright rights of others. Furthermore, the Member may not engage in any activity or transaction (spam, viruses, trojan horses, etc.) that prevents or hinders others from using the services.

3.5. The ideas and opinions declared, written, or used by Members on the website online.hafizmustafa.com are entirely the personal views of the Members and bind only the person expressing them. These views and opinions have no relation or connection whatsoever to HAMİDİYE ŞEKERLEME. HAMİDİYE ŞEKERLEME bears no liability whatsoever for damages that third parties may suffer due to the ideas and opinions expressed by a Member, or for damages that a Member may suffer due to the ideas and opinions expressed by third parties.

3.6. HAMİDİYE ŞEKERLEME shall not be liable for the reading of Member data by unauthorized persons or for any damage that may occur to the Member's software and data. The Member has agreed in advance not to claim compensation from HAMİDİYE ŞEKERLEME for any damage that may be incurred due to the use of the website online.hafizmustafa.com.

3.7. The Member agrees not to access or use the software and data of other internet users without authorization. Otherwise, all legal and criminal liability arising therefrom shall belong entirely to the Member.

3.8. A Member who violates one or more of the provisions listed in this membership agreement shall be personally liable, both criminally and legally, for such violation, and shall hold HAMİDİYE ŞEKERLEME harmless from the legal and criminal consequences of such violations. Furthermore, should the matter be brought before the courts as a result of such violation, HAMİDİYE ŞEKERLEME reserves the right to claim compensation from the Member for failure to comply with the membership agreement.

3.9. HAMİDİYE ŞEKERLEME has the right, at any time and unilaterally when necessary, to delete the Member's membership and to delete the customer's files, documents, and information. The Member accepts this action in advance. In this case, HAMİDİYE ŞEKERLEME bears no liability whatsoever.

3.10. The software and design of the website online.hafizmustafa.com are owned by HAMİDİYE ŞEKERLEME, and the copyright and/or other intellectual property rights related thereto are protected by the relevant laws; they may not be used, acquired, or altered by the Member without permission. Other companies and their products mentioned on this website are the trademarks of their respective owners and are also protected under intellectual property rights.

3.11. For the purpose of improving and developing the website online.hafizmustafa.com and/or within the framework of applicable legislation, certain information may be collected by HAMİDİYE ŞEKERLEME, such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site, the date and time the site was accessed, the pages accessed while on the site, and the Internet address of the website that provided direct access to the site.

3.12. HAMİDİYE ŞEKERLEME may use Members' personal information in efforts aimed at users' specific preferences and areas of interest in order to provide better service to its users, improve its products and services, and facilitate the use of the site. HAMİDİYE ŞEKERLEME reserves the right to keep a record of the Member's activities on the website online.hafizmustafa.com.

3.13. A person who becomes a member of HAMİDİYE ŞEKERLEME represents and accepts that they permit HAMİDİYE ŞEKERLEME to present them with product and service promotions, advertisements, campaigns, benefits, surveys, and other customer satisfaction practices, within the scope of current and/or future applicable practices. The Member represents and accepts that they permit the collection, for the above purposes, of their personal and shopping information as well as their shopping and/or consumer behavior information, whether provided in the past or to be provided in the future while becoming a member of HAMİDİYE ŞEKERLEME and/or by other means, and permit such information to be shared with all affiliated companies and used and archived by HAMİDİYE ŞEKERLEME and all affiliated companies. Unless the Member states otherwise, they represent and accept that they permit the collection, sharing with all affiliated companies, and use and archiving by HAMİDİYE ŞEKERLEME and all affiliated companies of such data even after their membership ends. Unless the Member states otherwise, they represent and accept that they permit HAMİDİYE ŞEKERLEME and all affiliated companies to contact them using communication channels such as internet, telephone, SMS, etc. The Member represents and accepts that they will not make any claim, and will not hold HAMİDİYE ŞEKERLEME and its affiliated companies liable, for any direct and/or indirect, material and/or moral, negative and/or positive damage of any kind whatsoever arising from the collection, sharing, use, archiving of, and access to, the above-mentioned information. Should the Member wish to change their data-sharing preferences, they may submit this request to HAMİDİYE ŞEKERLEME's customer service call centers.

3.14. HAMİDİYE ŞEKERLEME may disclose the Member's personal information when requested as a legal obligation, or when it determines in good faith that such disclosure is necessary in order to: a) act in accordance with legal requirements or comply with legal proceedings served on HAMİDİYE ŞEKERLEME; b) protect and defend the rights and property of HAMİDİYE ŞEKERLEME and the family of HAMİDİYE ŞEKERLEME websites.

3.15. Measures have been taken, to the extent possible, to keep the HAMİDİYE ŞEKERLEME website free of viruses and similar malicious software. In addition, in order to ensure ultimate security, the user must obtain their own virus protection system and provide the necessary protection. In this context, by entering the HAMİDİYE ŞEKERLEME website, the Member shall be deemed to have accepted that they are responsible for any errors that may occur in their own software and operating systems, and for the direct or indirect consequences thereof.

3.16. HAMİDİYE ŞEKERLEME reserves the right to change the content of the site at any time, to modify or terminate any service provided to users, or to delete user information and data registered on the HAMİDİYE ŞEKERLEME website.

3.17. HAMİDİYE ŞEKERLEME may at any time change, update, or cancel the terms of the membership agreement in any manner whatsoever, without any need for prior notice and/or warning. Any provision that is changed, updated, or repealed shall take effect for all Members as of its publication date.

3.18. The Parties accept and declare that all computer records belonging to HAMİDİYE ŞEKERLEME shall be taken as the sole and true exclusive evidence, in accordance with Article 287 of the Turkish Code of Civil Procedure (HUMK), and that such records constitute a binding evidentiary agreement.

3.19. Pursuant to this membership agreement, HAMİDİYE ŞEKERLEME is authorized to send informational e-mails to the e-mail addresses and informational SMS messages to the mobile phone numbers registered by its Members; by approving this membership agreement, the Member shall be deemed to have accepted the sending of informational e-mails to their e-mail address and informational SMS messages to their mobile phone.

Termination of the Agreement

This agreement shall remain in effect until the Member cancels their membership or their membership is cancelled by HAMİDİYE ŞEKERLEME. Should the Member violate any provision of the membership agreement, HAMİDİYE ŞEKERLEME may unilaterally terminate the agreement by cancelling the Member's membership.

Resolution of Disputes

The Istanbul Courts and Execution Offices shall have jurisdiction over disputes arising from this agreement.

Effective Date

The Member's completion of membership registration means that the Member has read and accepted all the provisions contained in the membership agreement. This Agreement is concluded and enters into mutual effect at the moment the Member becomes a member.
